Acceptance of Terms
1 Binding Agreement
By accessing or using Voxcruit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are using Voxcruit on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.
2 Eligibility Requirements
To use Voxcruit, you must:

Corporate Accounts Only
Recruiter accounts on Voxcruit are restricted to:
- Verified corporate email addresses (no personal email services)
- Legitimate businesses and recruitment agencies
- Authorized representatives of hiring organizations
We reserve the right to reject any account registration that does not meet these criteria or appears to be fraudulent.
Registration Process
Provide Corporate Information: Use your official company email address and provide accurate organization details.
Email Verification: Verify your email address through the confirmation link sent to your corporate email.
Account Approval: Our team reviews new accounts to ensure compliance with our corporate account policy.

Candidate Responsibilities

Candidates must participate in interviews personally and not use proxies or third parties.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

- Ensure your password is changed at least twice a year.

- Log out after each session, especially on shared devices

9 Voxcruit Intellectual Property
All intellectual property rights in the Voxcruit platform, including but not limited to:

- Documentation and training materials
- Brand names, logos, and trademarks
- Patentable inventions and trade secrets
are owned by Voxcruit or its licensors and a re protected by intellectual property laws.
License Grant
Subject to these terms, Voxcruit grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the platform for legitimate hiring purposes
- Use provided tools and features as intended
- Generate and review interview content
This license does not include rights to copy, modify, distribute, or create derivative works of the platform.
10 User Content Rights
For content you upload or create on Voxcruit (resumes, interview responses, job descriptions):
- Ownership: You retain ownership of your original content
- License to Voxcruit: You grant us a license to use, process, and store your content to provide services
- Candidate Content: Candidates grant recruiters license to use interview content for hiring evaluation
- AI Processing: You consent to AI processing of your content for service delivery

15 Cancellation Process
To cancel your subscription:
- Free Trial: No payment required, no refunds applicable
- Credits Purchases: Credits are non-refundable once purchased
- Unused Credits: No refunds for unused or partially used credits
- Usage-Based Charges: No refunds for credits spent on completed actions or services
- Service Issues: Refunds or credit reimbursements may be considered only for significant service failures
Note: Cancellation does not entitle you to refunds for unused credits, except as specified above.

- Continuous availability without interruption
Liability Limitation
17 Limitation of Liability
To the maximum extent permitted by law, Voxcruit and its affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Damages related to hiring decisions made using our platform
- Costs of procuring substitute goods or services
- Damages exceeding the amount paid to Voxcruit in the past 12 months
Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

AI & Evaluation Disclaimer
Voxcruit's AI systems are decision-support tools, not decision-makers. Important limitations include:

- Scores are based on algorithms, not human judgment
- AI may not capture all relevant candidate qualities
- Technical limitations may affect evaluation accuracy
- AI should never be the sole basis for hiring decisions
18 Recruiter Responsibility
Recruiters are solely responsible for:
- Making final hiring decisions based on comprehensive evaluation
- Complying with employment laws and anti-discrimination regulations
- Verifying candidate information and qualifications
- Ensuring fair and equitable hiring processes
- Using AI evaluations as one factor among many in decision-making
Voxcruit is not responsible for hiring decisions made using our platform.

19 Termination by You
You may terminate your use of Voxcruit at any time by:

Termination does not relieve you of any obligations incurred prior to termination, including payments for credits already purchased.
20 Termination by Voxcruit
We may suspend or terminate your access to Voxcruit:
- For violations of these Terms of Service
- For fraudulent, abusive, or illegal activities
- To comply with legal or regulatory requirements
- For security or technical reasons
- For non-payment of required fees (e.g., failed credit purchases)
- At our discretion with 30 days’ notice
Effect of Termination
Upon termination:
- Your right to use Voxcruit immediately ceases
- Your account and access may be disabled
- Unused credits are non-refundable unless required by law
- You may continue to view your data while the account is active; however, no data export or download tools are currently available
- Your data will be retained and deleted according to our Privacy Policy
- Provisions intended to survive termination will remain in effect

21 Governing Law
These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh, without regard to conflict of law principles.
22 Dispute Resolution
Informal Resolution: Before pursuing formal dispute resolution, both parties agree to attempt to resolve disputes informally through good-faith negotiation.
Arbitration: If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the Arbitration Act of Bangladesh.
- Arbitration shall take place in Dhaka, Bangladesh, unless otherwise mutually agreed
- Proceedings shall be conducted in English or Bengali
- Each party shall bear its own costs, unless the arbitrator determines otherwise
- The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction
23 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, collective, consolidated, or representative action.
Time Limitation for Claims
Any claim or cause of action arising out of or related to these Terms of Service or the use of Voxcruit must be filed within one (1) year after the cause of action arises, unless prohibited by applicable law.
Jurisdictional Provisions
EU/UK Users
Users in the European Union or United Kingdom may be entitled to rights under local consumer protection laws. These Terms do not limit statutory rights that cannot be waived.
International Users
Voxcruit operates globally but is based in Bangladesh. By using our services, you consent to the processing of your data in Bangladesh, subject to our Privacy Policy.
